Terms of Service

These terms govern your use of NexYear Gifting, a service of NexYear Consulting, LLC. By requesting a gift or using our site, you agree to them.
1. The service
NexYear Gifting provides concierge strategic gifting: we help you source, curate, wrap, and deliver gifts to recipients you designate. We act on your instructions and represent your intent to the recipient.
2. Orders, quotes & pricing
Gift requests are proposals until we confirm them. Quoted prices are blended and reflect goods, sourcing, wrapping, and delivery. Prices may change if your requirements change or if a vendor's pricing or availability changes; we will confirm any material change before proceeding. Payment terms are stated on your quote or invoice.
3. Sourcing & delivery
We select vendors and carriers to meet your occasion and deadline, and we flag lead times that put a deadline at risk. Delivery dates are targets, not guarantees, once a gift is in a carrier's hands. Title and risk of loss for goods pass on delivery to the recipient's address you provide.
4. Acceptable use
You agree to provide accurate recipient information, to have the right to send gifts to the recipients you designate, and not to use the service for unlawful, harassing, or deceptive purposes. We may decline or cancel any request at our discretion.
5. Intellectual property
The NexYear and NexYear Gifting names, logos, and site content are the property of NexYear Consulting, LLC and may not be used without permission. Content you provide (such as a card message) remains yours; you grant us the limited right to use it to fulfill your gift.
6. Warranties & liability
The service is provided “as is” to the fullest extent permitted by law. NexYear Consulting, LLC is not liable for indirect or consequential damages, and our total liability for any order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law.
7. Changes to these terms
We may update these terms from time to time. Material changes take effect when posted here, and your continued use of the service constitutes acceptance.
